Sunday evening October 6 Sioux Falls Police officers were called to a residence for a weapons violation where an uninvited man came with a gun.

29-year old Trent Wagner of Baltic, South Dakota attempted to flee the residence when officers arrived. A foot pursuit took place and during the chase, while officers were shouting at Wagner to drop the gun, Wagner fired his revolver, a “The Regent” Model .22 that holds eight rounds.

One of the police officers fired his gun at Wagner hitting him three times. Wagner was handcuffed and taken to a hospital for treatment of his gunshot wounds.

Wagner tested positive for methamphetamine by the South Dakota Health Laboratory.

According to the Attorney General’s report, Wagner said, “I didn’t want to go back alive.”

The report states that the officer was justified in using deadly force.
