Judge Says Past DUIs Can be Considered in Sentence of Sioux Falls Woman

CANTON, S.D. (AP) — A judge has rejected an effort by a Sioux Falls woman to have her potential prison term reduced if she's found guilty of aggravated assault against a highway patrol officer.

Rachel Coleman is charged with attempted murder and aggravated assault for the Oct. 17 incident.

Authorities say the 26-year-old Coleman struck Trooper Andrew Steen with her car while he was trying to pull her over for erratic driving.

Defense attorney Jason Rumpca argued Friday that Coleman's past convictions for drunken driving should not factor into the maximum penalty if she is convicted of aggravated assault. Rumpca says the charge already carries a stiffer penalty because it involves a law enforcement officer.

The Argus Leader reports that Circuit Judge Joseph Neiles denied the motion. Trial is scheduled for Jan. 21.
