KXRB’s ‘Say It, Don’t Spray It’ Contest Rules

SAY IT DON’T SPRAY IT - RULES

Entry Period Dates: March 24, 2025 – April 25, 2025

On the dates listed above, KXRB/Townsquare Media, Inc., will conduct ‘Say It Don’t Spray It’ contest on-air. To participate in the contest, contestants must agree to adhere to the contest rules below:

1. Eligibility:

‘Say It Don’t Spray It’ is open to legal residents of South Dakota, Iowa, and Minnesota who are at least 18 years old as of the date of entry. Employees of Contest Organizers, its affiliated radio stations and their respective immediate family members are not eligible to participate.

2. How to Play/Enter:

KXRB will play a 10-20 second song clip 3 times daily (8:20 AM, 11:20 AM, 3:20 PM). Listeners are encouraged to finish the lyric in the KXRB Mobile APP & Website to be qualified to win the ATV & Sprayer. Contestants must match the exact phrase to be eligible to win ATV/Sprayer. Each contestant is only able to submit a total of (3) correct Phrase entries each day throughout the contest period.

Winner Selection/Grand Prize: The grand prize of an ATV and Sprayer will be awarded to one qualified contestant on April 28th at 8 AM during the Morning Show. The winning contestant’s name will be announced live on-air and contacted by a representative of the station at that time.

If chosen as a winner, the entrant must return the station’s call or email within 48 hours or risk forfeiture of prize. If KXRB is unable to connect with the entrant within 48 hours, Townsquare Media/KXRB reserves the right to choose another winner.

After being chosen, the winner must fill out all paperwork (including verification of eligibility and a liability and publicity release) and claim his/her prize from Townsquare Media/KXRB

within two (2) weeks from the date winner returns the station’s call or email notifying winner that he/she has won, or winner risks forfeiture of the Prize.

At the Company’s discretion, winners may be required to receive the prize via mail, to pick up the prize at the participating station, or to receive the prize via another method specified by the Company. Failure to claim the Prize within the time frame above constitutes forfeiture of the Prize.

Cash prizes will be awarded within a (90) day period from the date the prize was originally awarded on-air.

Prizes are not transferable or exchangeable for any other prize or equivalent prize. Prize(s) are subject to availability. Odds of winning a prize depend on the number of eligible entries with respect to the applicable drawing.

5. Technical Issues:

Should a technical problem or other issue (such as, without limitation, computer error, human error or transmitter difficulties) result in a ‘Say It Don’t Spray It’ airing at the incorrect time, Townsquare Media/KXRB will have the right not to accept entries associated with such phrase. KXRB and Townsquare Media will not be responsible or liable for any technical problems or other issues.

6. Conditions and Limitations:

Townsquare Media/KXRB reserves the right to refuse to award a prize to a selected winner in the event of noncompliance with these rules. Winners are subject to a verification process to include winner's name, address, home phone number, work/cell phone number, and social security number. If a winner is disqualified, Townsquare Media/KXRB reserves the right to disqualify the winner.

7. Disclaimer:

Townsquare Media/KXRB is not responsible for and disclaims all liability for, any inability of a participant to complete an entry due to equipment malfunction, internet connection issues, inadvertent disconnections, acts beyond Townsquare Media’s control, or any other error, failure or defect of any kind. Townsquare Media/KXRB disclaims all liability for any delays, mis-delivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. Entries must be made as detailed herein. No photocopies or mechanical reproductions of entry forms are permitted. Townsquare Media/KXRB is not responsible for human, mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online entrant's ability to participate in the, and any injury or damage to entrant's or any other person's computer related to or resulting from

participating in or downloading any information necessary to participate in the ‘Say It Don’t Spray It’ Contest.

8. Publicity; Use of Personal Information:

By participating, all participants and winners grant Townsquare Media-KXRB permission to use their names, characters, photographs, voices, and likenesses in connection with the promotion. Participants waive any claims to royalty, right, or remuneration for such use.

9. Taxes:

Each winner is solely responsible for reporting and paying any and all applicable taxes. Townsquare Media/KXRB reserves the right to withhold and deduct taxes and charges from the prize if and to the extent required by law. Each winner must provide Townsquare Media/KXRB with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Prizes are not transferable, redeemable for cash or exchangeable for any other prize. Any person winning over $600 in prizes from the Stations will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.

10.Conduct and Decisions:

By participating in the ‘Say It Don’t Spray It’ contest, participants agree to be bound by the decisions of Townsquare Media/KXRB, which are final and binding. Persons who violate any rule, gain unfair advantage in participating in the contest, or obtain winner status using fraudulent means will be disqualified.

11. Compliance

Each winner must submit proof of eligibility and sign the Company's release form to claim the prize. No purchase necessary to participate or win. Void where prohibited.

Written copies of these rules are available during normal business hours at the business offices of KXRB Sioux Falls. All entries become the property of the Company and will not be returned.
