Update: Two Dead in Westside Sioux Falls Gas Station Shooting
**UPDATE**
Two people have died resulting from a self-defense shooting that happened Thursday night, (October 10) at a convenience store on Sioux Falls westside.
Dakota News Now is reporting that shots were fired Thursday night shortly before 10 PM in what appears to be a case of mistaken identity that resulted in an act of self-defense.
According to Dakota News Now, a woman pointed a gun at a motorcyclist, while two male companions she was with swung baseball bats at him.
The 26-year-old motorcyclist also had a gun and used his firearm to defend himself against the two attackers, who were ultimately shot and killed during the incident.
Sam Clemens with the Sioux Falls Police Department told Dakota News Now, "There are laws in South Dakota that allow for self-defense and we encourage people to get themselves out of those situations if possible."
The South Dakota "Stand Your Ground" law is in place if a person believes using or threatening to use force is necessary to defend themselves against another person's imminent use of unlawful force.
Dakota News Now reports that an investigation will take place to determine if any charges will ultimately be filed against the motorcyclist involved in the incident.
Clemens told Dakota News Now, “Just because there are allowances in state law for self-defense, doesn’t mean that there couldn’t be some charges and so I just want to make that clear. Certainly, this seems to be a case on the surface of self-defense where somebody’s swinging a baseball bat, which could be considered a dangerous weapon or deadly weapon, but that’ll be a determination that’s made by the state’s attorney’s office."
Regardless, Thursday night's case of mistaken identity was absolutely tragic and completely unnecessary.
