RAPID CITY, S.D. (AP) - The mother of a gunman who attacked people at a Rapid City homeless shelter before being killed by police wants her son's gun back.

The Rapid City Journal reports Jackie Giago asked Judge Matthew Brown this week to give her the 9 mm handgun. She said her son, Earl Hicks, bought the weapon to protect her and her husband "from bad men." She also said it might help her come to terms with her son's death.

Authorities seized the gun after Hicks shot a man at the Cornerstone Rescue Mission on Feb. 28. The man recovered. Hicks was shot and killed by a police officer who responded to the scene.

The attorney general's office has asked Brown to deny Giago's request. Brown did not immediately rule.
