SIOUX FALLS, S.D. (AP) — The family of a Sioux Falls teenager who admitted to playing a role in the fatal shooting of another teen wants his plea deal tossed out after his co-defendant was found not guilty.

The Argus Leader reports 19-year-old Robert Montes pleaded guilty to being an accessory to murder in August in exchange for prosecutors dropping a murder and manslaughter charges against him.

Montes admitted to driving while co-defendant Conner Hanson shot and killed 18-year-old Anthony Gabriel.

On Wednesday, jurors found Hanson not guilty of all charges.

Montes is awaiting a sentencing hearing, but now that Hanson has been found not guilty, his step father says the deal should be dismissed.

Minnehaha County State's Attorney Aaron McGowan said the outcome of Hanson's trial has no bearing on Montes' plea deal.
