(AP) - Authorities in New York State say they pulled David Cassidy over for failing to dim his headlights - only to find that it wasn't just his beams that were on "high."

They have charged The Partridge Family singer with DWI. Police in Schodack (SKOH'-dack) say Cassidy was pulled over this week when he failed to switch off his high beams - and tests showed his blood alcohol level was .10, higher than the state legal limit of .08.

Usually the charge is a misdemeanor, but it's being bumped up to a felony because Cassidy has a 2011 conviction for DUI in Florida, where he lives.

Cassidy is now free on $2,500 bail and has a court date set for September 4. Cassidy is 63.
