SIOUX FALLS, S.D. (AP) — The South Dakota Supreme Court is considering whether criminal defendants should be able to see the disciplinary records of law enforcement officers who arrested them.

The Argus Leader reports that justices heard arguments this week in a case involving Minnehaha County Sheriff's Office personnel records.

Emily Lou Smith was arrested during a September 30th, 2014 traffic stop. She's charged with resisting arrest, simple assault against a law officer and driving under the influence.

Smith's attorney sought personnel records for the arresting officer to see if any complaints had been filed against him for excessive force. A circuit court judge agreed to the request, but prosecutors are objecting.
