South Dakota Involved in EPA Case Accepted by Supreme Court

PIERRE, S.D. (AP) — The state of South Dakota is a plaintiff in a challenge of environmental regulations that will be heard by the U.S. Supreme Court.

The high court has accepted six cases that challenge the Environmental Protection Agency's regulation of carbon dioxide and other greenhouse gas emissions. The Supreme Court will decide whether the EPA's authority to regulate automobile emissions of greenhouse gases as air pollutants also applies to power plants and factories.

One of the cases accepted by the high court was filed by South Dakota, Texas, North Dakota and eight other states that argue the EPA's regulation goes beyond the agency's legal authority.

South Dakota Attorney General Marty Jackley says the state estimates the new regulations may require 1,000 South Dakota facilities to get air permits for the first time.
