He was sleeping in a car, but once police arrived he wound up going to jail on a felony charge and a list of misdemeanors.

Sioux Falls Police Captain Greg VandeKamp says officers were called around 3:20 p.m. Wednesday to a motel in the 1200 block of West 12th Street after someone noticed the sleeping man in the car. But VandeKamp says when officers woke the man up, he became disorderly.

"He failed to comply with anything they said, started becoming aggressive. The decision to place him under arrest for disorderly conduct was made given the circumstances of being passed out in his vehicle as well," explained VandeKamp. "During the arrest a struggle ensued. No officers were injured in this, however in taking him back to the patrol car he was able to kick one of the patrol cars and damage that as well."

VandeKamp says 31-year-old Andre Whitt of Sioux Falls was charged with disorderly conduct, threatening a law enforcement officer, resisting arrest, second-degree intentional damage to property and simple assault on law enforcement.

He says Whitt damaged the rear quarter-panel of the squad car by kicking it.
