A homicide case in Fall River County that has been open since January has a Sioux Falls connection. It’s up to the state to prove the case.

According to the Attorney General’s office, a grand jury has indicted 26-year old Thomas P. Lucero, Jr. of Sioux Falls in the death of 32-year old Moses Dubray. In a press release, Marty Jackley indicates that Lucero faces counts of first degree murder, second degree murder, and aggravated assault.

Dubray who was in state custody for committing a crime in Bennett County had walked away from the Rapid City Community Work Center on January 10, 2017. Dubray’s body was found near Hot Springs along SD Highway 89 a day later.

Lucero has been in custody at the South Dakota State Penitentiary since January after voluntarily surrendering to authorities as a parole absconder. Lucero was arrested on robbery charges in Sioux Falls back in 2012 and paroled back in 2015.

If convicted on a murder charge, Lucero would face a mandatory life prison sentence. It is also possible that the state could seek the death penalty.
