ABERDEEN, S.D. (AP) — A man sentenced to more than 40 years in prison in connection with the armed robbery of an Aberdeen casino a year ago is appealing his conviction.

Thirty-four-year-old Roger Kihega, of Cokato, Minnesota, was sentenced late last year to serve 38 years on robbery and weapons charges and an additional five years for attempted witness tampering.

He and another man were convicted of robbing Casino Korner on Jan. 19, 2015, and firing shots in the air. No one was hurt.

The American News reports that Kihega has appealed to the South Dakota Supreme Court. His defense attorney believes there was insufficient evidence for a conviction.
