DEADWOOD, S.D. (AP) — A Meade County commissioner is facing charges stemming from a dispute over payment for a private job contract.

A grand jury has indicted 52-year-old Alan Aker on a felony charge of intentional damage to property and a misdemeanor count of trespassing.

Authorities allege that Aker entered a client's property in Deadwood, sawed off part of a deck railing and took it with him.

Aker maintains he did nothing wrong because he hadn't been fully paid for the job. The property owner maintains the project wasn't complete.

Aker is due in court May 16. The most serious charge against him carries a maximum punishment of five years in prison.

Aker has served on the Meade County Commission since 2009.
