KSOO News has learned that the South Dakota Secretary of State’s Office is examining the Libertarian party registrations of two of its candidates, attorney general candidate Chad Haber and Public Utilities Commissioner candidate Ryan Gaddy.

South Dakota Libertarian Party chair Emmett Reistroffer told KSOO News today (Wednesday) that the Secretary of State was looking at their registrations because they had registered as Libertarians just prior to the party’s convention Saturday in Sioux Falls.

However, South Dakota Codified Law 12-6-3.2 appears to require that candidates be registered to vote in their party of choice prior to being nominated by their party.

As of Wednesday afternoon, the Secretary of State’s voter registration website application noted that both Sioux Falls men were still registered as Republicans and not Libertarians.

If not considered “registered” by Secretary of State Jason Gant, the two men could be dropped from the November ballot.

Tuesday was the last day for candidates or replacement candidates to be certified for the general election ballot.
