ABERDEEN, S.D. (AP) — The attorney for an Aberdeen man accused of killing another man wants his client's indictment thrown out.

The American News reports that defense attorney Tom Tonner filed the motion Monday on behalf of 54-year-old Bradley Quist. A hearing date was not immediately scheduled.

Quist has pleaded not guilty to felony manslaughter in the May 2015 death of 61-year-old Ronald Witchey. He's to stand trial in late April.

An autopsy determined Witchey died from blunt-force trauma to the face and head. Tonner's motion says that since the body was later cremated, no alternate autopsy could be conducted.

Brown County Coroner Mike Carlsen says all autopsies are documented and videotaped, and tissue samples are retained.
